These TERMS AND CONDITIONS govern the relationship between Comfy Cloud (referred to as "Comfy Cloud", "we", "us", or "our") and users of the website and online services available at comfy-cloud.co.uk (referred to as "Users", "you", or "your").

Basic Terms

"USER" – any individual who uses one or more services of the Comfy Cloud website.

"SERVICE/SERVICES" of the website include:

  • booking and reservation services for vacation rental properties.
  • concierge services and property management information.

The services offered on the Comfy Cloud website are primarily informational. These Terms and Conditions do not govern the relationships between Comfy Cloud and its contractual clients, which are subject to separate agreements.

"DIRECT MARKETING" – the offering of goods and services to Users through traditional or electronic mail, telephone, or other direct means.

Identification

Article 1

(1) Comfy Cloud identifies Users of the website by storing log files on the server and the User's IP address.

(2) Comfy Cloud has the right to collect and use information about Users after their identification. This information may include name, date of birth, gender, address, telephone, as well as any other data voluntarily provided by the User.

Article 2

(1) Comfy Cloud makes all necessary efforts and is responsible for the protection of User information, except in cases of force majeure, fortuitous events, or malicious actions by third parties.

(2) In the identification form, Comfy Cloud indicates the mandatory or voluntary nature of data provision and the consequences of refusal. By accepting these Terms and Conditions and the Privacy Policy, the User consents to the processing of their data in accordance with these documents.

(3) The above restrictions do not apply in cases where Comfy Cloud has a legal obligation to provide personal data to competent authorities.

Article 3

(1) Comfy Cloud collects and uses information for the purposes set out in these Terms and Conditions, as well as for offering new goods and/or services (free or paid).

(2) By accepting these Terms and Conditions, the User expresses consent for the processing of their data for direct marketing purposes.

Article 4

(1) The User may identify themselves by completing the electronic online form and accepting these Terms and Conditions, declaring that they are legally capable.

(2) Identification constitutes an electronic declaration in accordance with legislation on electronic documents and signatures. Comfy Cloud may retain the IP address and other data necessary for identification in case of a dispute.

(3) The User is obliged to provide complete, correct, and up-to-date data and guarantees their accuracy.

Intellectual Property

(1) All materials and resources on the Comfy Cloud website are protected by copyright legislation and belong to Comfy Cloud or its licensors.

(2) The right of access does not include the right to copy or reproduce, except for personal, non-commercial use within reasonable limits.

(3) Any violation entitles Comfy Cloud to seek full compensation.

(4) The User undertakes to respect the law, good morals, the rights of third parties, and not to engage in fraudulent or illegal activities.

(5) Reproduction, modification, publication, or distribution of content is prohibited without express consent.

Limitation of Liability

Article 6

(1) Comfy Cloud makes efforts to provide accurate and current information, without guaranteeing the absence of errors or cyber attacks.

(2) Comfy Cloud is not responsible for subjective interpretations by Users.

(3) Comfy Cloud is not responsible for the content of third-party websites to which links exist.

Termination of Contract

Article 7

(1) The contract terminates in the event of suspension of Comfy Cloud's activities or the website.

(2) The User may terminate the use of services at any time.

Regulatory Authorities

Article 8

The competent authorities are:

  • Information Commissioner's Office (ICO) - for data protection matters
  • Trading Standards - for consumer protection matters

Severability Clause

Article 9

The invalidity of one clause does not affect the validity of the other provisions.

Modification of Terms

Comfy Cloud reserves the right to modify these Terms and Conditions, with publication on the website.

Applicable Law

Article 11

For all unregulated aspects, the applicable law of England and Wales shall apply.
